Footway Restaurants
Council's Environmental Health Officer is responsible for regulating footway and outdoor dining restaurants. The aim is to protect public health, ensure safe pedestrian access and enforce compliance with the Roads Act 1993, Environmental Planning and Assessment Act 1979 and the Local Government Act 1993.
How to apply for approval for a Footway Restaurant
1. Gather your documents
Approval to use a portion of the footway for a Footway Restaurant is made under Part 9, Section 125 of the Roads Act 1993.
As part of this application you will need to provide the following documents:
- A diagram of the proposed footway restaurant area which includes:
- width of access for pedestrians
- frontage of the site, size of the area proposed to be used and
- location of proposed furniture and details of any other street furnishes such as existing obstructions
- A brochure or photograph of the type of furniture to be used (see Council's Footway Restaurant Settings Policy)
- Evidence of adequate public liability insurance for $20,000,000 (your insurance provider will need to provide you with a "Certificate of Currency" which should list Broken Hill City Council under "Interested Party" with regard to footway dining, provide an expiry date and the amount of public liability coverage.
2. Pay
Annual charges are listed in Council's Schedule of Fees and Charges.
Fees will be calculated by Council staff and provided to you in writing after we have received your application.
You will not be issued an approval until all fees have been paid.
3. Apply
Once you have gathered the required documents, you can apply online for a Footway Restaurant Settings Approval. You will need to upload electronic versions of the required documentation in order to complete your application.
